I recognize that virtual consults offered by Fourth Trimester Foundations (the “Service”) is voluntary and I do so at my own risk. 

We are nurses by profession, but not your nurse. Everything on this website, purchased through this website and posted on our Instagram, Facebook, TikTok and Twitter accounts is for informational and educational use only. This does not replace medical advice and does not mean a patient-client relationship is formed. A patient-client relationship with you is only started after we have initiated and signed a personalized, written agreement, which includes our payment structure and other terms to represent you. Engaging in and purchasing the Service does not indicate the patient-client relationship is formed. The Programs and the Services may include but are not limited to educational seminars concerning child development vis-à vis health, nutrition, and fitness. These educational sessions ARE NOT INTENDED TO SERVE  AS MEDICAL ADVICE AND CANNOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL  MEDICAL ADVICE, DIAGNOSIS OR TREATMENT THAT CAN BE PROVIDED BY A  PHYSICIAN OR MIDWIFE. THE  INSTRUCTOR IS NOT PROVIDING MEDICAL SERVICES. Services are conducted through  technological channels including, but not limited to, Zoom, Instagram video, or Facetime which may  or may not be secure networks.

I understand and agree that all information provided in the Program and the Service is for informational purposes only and is not a replacement for medical advice from a physician or midwife. The Program and the Service does not replace the relationship between physician/midwife with an individualized treatment plan based on their professional evaluation.   

I will not rely on the Program/Service as an alternative to advice from my medical professional or healthcare provider and I will never delay seeking medical advice, disregard medical advice, or discontinue medical treatment as a result of any information provided in the Program/Service. I recognize that virtual consults between our staff members and you (collectively, the “Service” or our “Services”), you agree to, and are bound by, these Terms of Use  (the “Terms” or “Agreement”) along with the other legal documents listed on the website, including  the Privacy Policy, which may but are not necessarily incorporated into this agreement by reference.   

Fourth Trimester Foundations, its paid educators and volunteers, are not liable to me for any claims, demands, injuries, damages, actions or causes of action to my person or property arising out of or connected with the Program and the premises where the Program is located. I expressly release Fourth Trimester Foundations, its agents and employees from all such claims, demands, injuries, damages, actions, or causes of action, and from all acts of active or passive negligence on the part of Fourth Trimester Foundations, to the extent such a release of negligence is permissible by law. 

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this Program. In the event of sickness, accident, or injury, I authorize Fourth Trimester Foundations and its representatives to obtain, on my behalf, emergency medical treatment at my expense. 

This Agreement shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. This Agreement shall be construed and enforced according to the laws of the State of New Jersey and any dispute under this Agreement must be brought in this venue and no other.  

I certify that I have read this fully and understand the content. I understand and agree that I am giving up legal rights by acknowledging this agreement and that I am doing so voluntarily, freely, under no threat of duress. Purchasing and reserving my spot in class it proof of my intention to execute a complete and unconditional waiver and release of all liability to the full extent of the law.
